Privacy Policy and Personal Data Protection Notice

INTRODUCTION

RING Solutions Sdn. Bhd. (henceforth referred to as “RING”) care about your personal data protection. This notice clarifies how RING processes your data from the point we collect, use, share, dispose of and the security measures that we have established to ensure your personal data is well protected.

RING will only collect, record, hold, use, disclose and store (i.e., “process”) your personal information in accordance with such laws (including the Personal Data Protection Act 2010 and other applicable data protection or privacy laws / regulations), this Privacy Notice, and the privacy terms in your agreement(s) with RING that you may have contracted with.

For the purposes of this Privacy Notice, please note that:

  1. “We” or “RING” refers to RING Solutions Sdn. Bhd.
  2. “Personal information” refers to any information which relates directly or indirectly to you and/or your transactions with us. This information includes your name, address, occupation, contact details, the details of your account(s), the type of products and/or services subscribed to and such other necessary information regarding yourself and your transaction(s) with us.
  3. The term “you” shall refer to all individuals and entities that access or utilise services offered through the RING Mobile and Web Applications (the “Service” or “Services”).
  4. The term “non-HCP User” shall refer to Users who are not using the Services in the capacity of a healthcare providers, hospitals, clinics, doctors & healthcare professionals.
  5. The term “HCP User” shall refer to Users who are using the Services in the capacity of a healthcare providers, hospitals, clinics, doctors & healthcare professionals.

COLLECTION OF PERSONAL DATA

RING will not record a user’s Personal Data except with the permission of and data voluntarily provided by the user. We collect your personal data which ranges from your name, address, email address, phone number, blood group, date of birth, diagnosis, Associated RING Groups and location.

SOURCE OF PERSONAL DATA COLLECTION

We gather your personal data from:

  1. New member registration forms available on our mobile application (for patients and healthcare professionals) and web application (for healthcare professionals only);
  2. Adding dependent information on our mobile application;
  3. During Medical Record Digital Transfer;
  4. Through your verbal or written communications with us via email, phone or mobile device, mail, websites or browsers, social media and/or any other appropriate communication channels;
  5. Cookies.

All data fields marked with an asterisk (*) on the registration forms are required for registration. Failure to communicate the mandatory data makes it impossible for RING to determine if the Services offered can be used by the User and the HCP, as it is impossible for the User to use the Application as it is intended to be used.

REASON FOR PERSONAL DATA COLLECTION

We collect your personal data to:

  1. To assess, address or fulfil your registration;
  2. To provide you with a better experience on our websites;
  3. To manage and maintain your account(s) with us;
  4. To better manage our business and your relationship with us;
  5. To understand your behaviour so that we can improve our current and future products, services, and advertising needs;
  6. To market and to provide you with information on selected products, services, offers and/or contests which may be of interest to you (in respect of which we may or may not be remunerated);
  7. To respond to you about any comment or enquiry you have submitted;
  8. To suggest the nearest medical facility to your location;
  9. To administer offers, competitions and promotions;
  10. To produce data, reports and statistics which have been anonymised or aggregated in a manner that does not identify you as an individual; and/or
  11. For any other purpose that is required or permitted by any law, regulation, guideline and/or the order of any court and/or relevant regulatory authorities.

No Personal Data collected by this App will be disclosed to any or transferred to a place outside of Malaysia for commercial purposes.

Please be assured that we will ask for your consent before using your personal information for a purpose other than those that are set out in this Privacy Policy and in the privacy terms in your agreement(s) with RING.

PROCESSING OF PERSONAL DATA

Your Personal Data may be transferred from country, state and city (“Home Country”) in which you are present while using our Services to another country, state and city (“Alternate Country”).

When we transfer your Personal Data from your Home Country to the Alternate Country, we will comply with our legal and regulatory obligations in relation to your Personal Data, including having a lawful basis for transferring Personal Data and putting appropriate safeguards in place to ensure an adequate level of protection for the Personal Data. We will also ensure that the recipient in Alternate Country is obliged to protect your Personal Data at a standard of protection comparable to the protection under applicable laws.

Our lawful basis will be either consent (i.e. we may ask for your consent to transfer your Personal Data from your Home Country to the Alternate Country at the time you provide your Personal Data) or one of the safeguards permissible by laws.

DISCLOSURE OF PERSONAL DATA

If you are a non-HCP user, we may disclose your personal data to:

  1. Your doctor to send you your medical records;
  2. A medical facility you book an appointment or connect with;
  3. Any other person under a duty of confidentiality to us which has undertaken to keep such information confidential;

If you are a HCP user, we disclose your personal data to:

  1. Your patients after sending them their medical records.
  2. Any other person under a duty of confidentiality to us which has undertaken to keep such information confidential;

We will treat your personal information as private and confidential and will not disclose your information to anyone outside RING except:

  1. Where you have given your express consent as set out in our application form(s) and/ or pursuant to your consent and authorisation as contained in this Privacy Notice and/or in the terms and conditions governing the products and services which you have with us and/or under any of your agreements with us;
  2. Where we are required or permitted to do so by law;
  3. Where required or authorised by any order of court, tribunal or authority, whether governmental or quasigovernmental with jurisdiction over RING;
  4. Where we may transfer rights and obligations pursuant to our agreement(s) with you; and/or
  5. Where we are required to meet our obligations to any relevant regulatory authority (whether in or outside Malaysia).

SECURITY MEASURE

We take these measures to protect your personal data:

  1. By ensuring your personal data is kept as required by
  2. By ensuring our staff do not misuse your personal data
  3. Data in transit are encrypted, while data at rest is stored in a highly secured server

Nevertheless, you are required to ensure the security of your email and password and not to disclose it to another party to reduce the risk of data breaches.

PERSONAL DATA RETENTION PERIOD

We will retain your personal data for as long as you are our customer. If you are no longer our , we will permanently delete your personal data.

Your encrypted healthcare data will temporarily be stored on our servers. Any file(s) that have been stored for more than 72 hours will be deleted during the next 12-hour interval check.

Your backup file(s) or shared file(s) will temporarily be stored on our servers. Any file(s) that have been stored for more than 24 hours will be deleted during the next 12-hour interval check.

Professional information pertaining to HCP users will be retained even if the account is disabled so as to maintain the complete data for the patient’s medical record transfer. The information retained is: Username, Full Name, Doctor Speciality and RING Account Status.

YOUR RIGHTS

You have the right to:

  1. Correct / update your personal data on our mobile application (for ) and our web application (for HCP users). Certain non-editable fields for HCP users can be corrected/updated by writing to us via email (info@ring.healthcare).
  2. Access your personal data which we process and keep with us.
  3. Stop any of our new promotional products / features sent to you via email.
  4. Withdraw your consent for us to process your personal data. If you wish to request that we no longer use your personal data or limit the usage of your personal data in any way whatsoever, please permanently delete your account via the RING app, or contact us at info@ring.healthcare.

Please note that RING may have to withhold access to your personal information in certain situations, for example when we are unable to confirm your identity or where information requested for is of a confidential commercial nature or in the event we receive repeated requests for the same information. Nevertheless, we will notify you of the reasons for not being able to accede to your request. Please also note that RING may use its discretion in allowing the corrections requested and/or may require further documentary evidence of the new information to avoid fraud and inaccuracy.

Please ensure your personal information (such as your mailing address(es), e-mail address(es) and telephone number(s) recorded with us are current, complete and accurate. Please notify us of any change in your personal particulars via the channels made available by us to ensure that all correspondence and/or communication reach you in a timely manner and to enable us to serve you better.

EFFECT IF PERSONAL DATA IS NOT SUFFICIENT

Where indicated (for example in application forms or account registration), it is obligatory to provide your personal information to us to enable us to process your application for our products or services. If the Personal Data provided is insufficient or unsatisfactory, then the User’s application or request for any of the above purposes may not be accepted; or action taken or use of the services offered by the App may be rejected or affected.

USERS UNDER THE AGE OF 18

The RING app and its related services are not directed at persons under 18 years of age.

INCONSISTENCY OR CONFLICT

In the event of any inconsistency or conflict between the English language version and the Bahasa Malaysia version, the English language version shall prevail.

REVISIONS TO PRIVACY NOTICE

The Privacy Notice may be amended and updated from time to time. A link to the most current T&C will be available on the home page of RING’s website, www.ring.healthcare, and we will indicate the date of the “Latest Update” at the bottom of the T&C.

You are required to visit this page periodically to review the most current T&C. Your continued use of the RMA and RWA Services following the posting of such changes constitutes your acceptance of the amended T&C.

After incorporation of the new content in the T&C and Privacy Policy, the User shall declare to have read and accepted the new content and all its content.

In case of modification, change or termination of any of the content in these T&C and Privacy Policy under sentence or judgement given by a competent court or under an award made by an arbitrator or by a court of arbitration, the other content that have not been modified, changed, or resolved remain in force and shall be valid for both parties.
